Chapter 16

א כל תלתין יומין בין א"ל מחמת הלולא ובין לא א"ל מחמת הלולא אסור מכאן ואילך אי א"ל מחמת הלולא אסור ואי לא אמר ליה מחמת הלולא שרי
1 during the entire thirty days [following a marriage celebration] whether he said to him that he was inviting him because of the banquet or not it is forbidden. From that time onward, if he invited him because of the marriage, it is forbidden, but if not, it is permitted.
ב וכי א"ל מחמת הלולא עד אימת אמר רב פפא עד תריסר ירחי שתא ומעיקרא מאימת אסור אמר רב פפא משמיה דרבא מכי רמו שערי באסינתי
2 And if he said that the invitation is because of the marriage, until when is it prohibited? Papa said: For twelve months. And from the outset when is it prohibited? Papa said in the name of Rava: From the time when the barley is placed in the tub.
ג ולבתר תריסר ירחי שתא שרי והא רב יצחק בריה דרב משרשיא איקלע לבי ההוא עובד כוכבים לבתר תריסר ירחי שתא ושמעיה דאודי ופירש ולא אכל שאני רב יצחק בריה דרב משרשיא דאדם חשוב הוא:
3 And after twelve months is it permitted? But did not R. Yitzchak the son of R. Mesharsheya, come to the house of a certain idolater more than a year after a marriage, and hear that they were thanking their gods and he refused to eat! Yitzchak the son of R. Mesharsheya is different, for he is an important man.
ד וקרטסים וכו': מאי קרטסים אמר רב יהודה אמר שמואל יום שתפסה בו רומי מלכות והתניא קרטסים ויום שתפסה בו רומי מלכות אמר רב יוסף שתי תפיסות תפסה רומי אחת בימי קלפטרא מלכתא ואחת שתפסה בימי יונים
4 Kratesis etc. What is Kratesis? Rav Judah said in the name of Shmuel: The day on which Rome seized the kingship. But was it not taught Kratesis and the day on which Rome seized the kingship? Joseph said: Rome seized the kingship twice; once in the days of Cleopatra, the queen [of Egypt] and in the days of the Greeks.
ה דכי אתא רב דימי אמר תלתין ותרין קרבי עבדו רומאי בהדי יונאי ולא יכלו להו עד דשתפינהו לישראל בהדייהו והכי אתנו בהדייהו אי מינן מלכי מנייכו הפרכי אי מנייכו מלכי מינן הפרכי
5 For when R. Dimi came he said: The Romans fought 32 battles against the Greeks and could not prevail against them until the Romans made an alliance with the Israelites. And these were the conditions made with them: If the kings are [chosen] from among us, the princes should be chosen from yours, and if the kings are chosen from among you, the princes shall come from us.
ו ושלחו להו רומאי ליונאי עד האידנא עבידנא בקרבא השתא נעביד בדינא מרגלית ואבן טובה איזו מהן יעשה בסיס לחבירו שלחו להו מרגלית לאבן טובה
6 Then the Romans sent to the Greeks as follows: Up until now we have been engaging in battle, now let us argue out in logic: A pearl and a precious stone which shall form a setting for which? They sent the reply: The pearl for the precious stone.
ז אבן טובה (ואינך) איזו מהן יעשה בסיס לחבירו אבן טובה לאינך אינך וספר תורה איזו מהן יעשה בסיס לחבירו אינך לספר תורה
7 And a precious stone and an onyx, which shall form a setting to the other? ‘ The precious stone to the onyx. And an onyx and a Sefer Torah which shall serve as the setting for the other? The onyx for the Sefer Torah.
ח שלחו להו [א"כ] אנן ספר תורה גבן וישראל בהדן כפו להו עשרין ושית שנין קמו להו בהימנותייהו בהדי ישראל מכאן ואילך אישתעבדו בהו
8 The Romans then sent word: In that case, the Sefer Torah is in our possession, for Israel is with us. Thereupon the Greeks gave in. For twenty-six years the Romans kept faith with Israel, thereafter they subdued them.
ט מעיקרא מאי דרוש ולבסוף מאי דרוש מעיקרא דרוש (בראשית לג, יב) נסעה ונלכה ואלכה לנגדך ולבסוף דרוש (בראשית לג, יד) יעבר נא אדני לפני עבדו
9 What did they expound at the outset and what did they expound at the end? At the outset they expounded: “Let us start on our journey and I will proceed at your pace” (Genesis 33:12). And at the end they expounded: “Let my lord now pass before his servant” (Genesis 33. 14).
י עשרין ושית שנין דקמו בהימנותייהו בהדי ישראל מנא לן דאמר רב כהנא כשחלה רבי ישמעאל בר יוסי שלחו ליה רבי אמור לנו שנים וג' דברים שאמרת לנו משום אביך
10 That Rome kept faith with Israel for twenty six years, from where do we know this? [From the following:] For R. Kahana said: When R. Yishmael b. Yose was ill they sent word to him: Rabbi, tell us two or three things which you told us in your father’s name.
יא אמר להו מאה ושמנים שנה קודם שנחרב הבית פשטה מלכות הרשעה על ישראל פ' שנה עד לא חרב הבית גזרו טומאה על ארץ העמים ועל כלי זכוכית מ' שנה עד לא חרב הבית גלתה סנהדרין וישבה לה בחנות
11 He said to them: One hundred and eighty years before the Temple was destroyed evil Rome cast her rule over Israel; eighty years before the destruction of the Temple they (the rabbis) decreed impurity on the lands of the nations and on glass vessels. Forty years before the Temple was destroyed the Sanhedrin was exiled from [the Temple] and dwelled in Hanut.
יב למאי הלכתא א"ר יצחק בר אבדימי לומר שלא דנו דיני קנסות דיני קנסות סלקא דעתך והאמר רב יהודה אמר רב ברם זכור אותו האיש לטוב ורבי יהודה בן בבא שמו שאלמלא הוא נשתכחו דיני קנסות מישראל נשתכחו לגרסינהו
12 What is the legal significance of this? Yitzchak b. Avdimi said: It indicates that [from that time onward] they did not adjudicate the laws of fines. “The laws of fines”! Do you really think so? Has not Rav Judah said in the name of Rav: That man R. Judah b. Baba should be remembered for good, for were it not for him the laws of fines would have been forgotten in Israel? “Forgotten”! Let them study them?
יג אלא בטלו דיני קנסות מישראל שגזרה מלכות הרשעה גזרה כל הסומך יהרג וכל הנסמך יהרג ועיר שסומכין בה תחרב ותחום שסומכין בו יעקר
13 Rather, the laws of fines would have been abolished; for the wicked Kingdom of Rome decreed that he who ordains a rabbi shall be put to death, and he who is ordained shall be put to death, the town in which an ordination takes place shall be destroyed and the border in which the ordination is held shall be laid waste.
יד מה עשה רבי יהודה בן בבא הלך וישב בין שני הרים גדולים ובין שתי עיירות גדולות בין ב' תחומי שבת בין אושא לשפרעם וסמך שם חמשה זקנים ר"מ ור' יהודה ור' יוסי ור"ש ורבי אלעזר בן שמוע ורב אויא מוסיף אף רבי נחמיה
14 What did R. Judah b. Baba do? He went and sat down between two mountains and between two large towns between two borders, namely, between Usha and Shefar’am and there he ordained five elders: R. Meir, R. Judah [b. Il’ai]. R. Yose, R. Shimon and R. Eleazar b. Shammua (R. Avia adds also R. Nehemiah).
טו כיון שהכירו בהם אויבים אמר להם בני רוצו אמרו לו רבי ואתה מה תהא עליך אמר להם הריני מוטל לפניהם כאבן שאין לה הופכין אמרו לא זזו משם עד שנעצו לגופו ג' מאות לולניאות של ברזל ועשאוהו לגופו ככברה
15 Once their enemies saw them, he said to them, “Flee, my children!” They said to him, “Rabbi, what about you?” He replied, “I lie before them as a stone that is not turned.” They say that the Romans did not move from there until they drove three hundred iron spears into his body and made his corpse like a sieve.
טז אמר רב נחמן בר יצחק לא תימא דיני קנסות אלא שלא דנו דיני נפשות
16 Nahman b. Yitzchak said: Do not say “cases of fines” but rather that they did not adjudicate capital cases.
יז מ"ט כיון דחזו דנפישי להו רוצחין ולא יכלי למידן אמרו מוטב נגלי ממקום למקום כי היכי דלא ליחייבו
17 Why? Because when the Sanhedrin saw that murderers were so prevalent that they could not be properly judged, they said: Rather let us be exiled from place to place than pronounce them guilty [of capital offences] for it is written
יח דכתיב (דברים יז, י) ועשית על פי הדבר אשר יגידו לך מן המקום ההוא מלמד שהמקום גורם:
18 “And you shall do according to the sentence that they tell you, from that place” (Deuteronomy 17:10). This indicates that the place matters.
יט מאה ושמנים ותו לא והתני רבי יוסי ברבי
19 One hundred and eighty years prior to the destruction (Rome conquered Israel). But was it not earlier? For R. Yose b. Rabbi taught:
